1. Participants shall be issued due compensation Thirty (30) days after the close of each calendar month.
2. The Minimum Balance shall be set at $35 US Dollars
3. All months that did not achieve the Minimum Balance shall have the balance be rolled over the the next payment day.
4. This program is available to all websites based in any country.
5. Participants may be paid either via the PayPal Service located at www.paypal.com, E-gold located at www.e-gold.com, or US partners can be paid via cheque. This will be determined by our sole discretion.
6. We can only payout to Partcipants based outside the United States with Pay Pal or E-gold.
7. Any check returned to us due to an invalid mailing address will be charged a $5 service fee.

2. Term and Termination

1. All terms presented here are only available to individuals who are able to form legally binding contracts under applicable law, if you are not able to form into this agreement then you are not eligible to participate in our program.
2. This agreement is void where prohibited.
3. Any illegal activity conducted with our "Program" is subject to applicable laws, in addition this contract shall be considered to be in breach if any illegal activities is preformed by any persons.
4. Any breach of this agreement preformed by you shall render your account void and be subject for monies withheld at our own discretion.

3. Liability

1. IN NO EVENT SHALL WE BE LIABLE FOR ANY DAMAGES INCLUDING BUT NOT LIMITED TO ACTUAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR "Program" OR THIS AGREEMENT.
2. You agree to abide by all appicable laws in using our "Program".
3. You agree to indemnify and hold harmless our employees from any claim or demand, including attorneys fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any  law or the rights of a third party.
4. You agree that You and ("Aquarius Media Services") are independent contractors, and that no partnership, employee-employer or franchisor-franchisee relationship is implied or created by this Agreement.
5. This Agreement shall be governed in all respects by the laws of the State of New Jersey.

4. Miscellaneous

1. Our Privacy Policy can be accessed by clicking here.
2. You are prohibited to list our Code on sites containing illegal content, or promoting hate.
3. Our Code appearing in Login Areas is strictly Prohibited. This means any page or script where Login is required or the main refering page requires a Login.
4. Offering any site any reward or incentive is only permited in our "Incentive Site" category.
5. Any device used in conjunction with our code is strictly prohibited. Sites that do this will be immediately removed without pay.
6. This Agreement can be changed at any time at the discretion of Aquarius Media Services with or without prior notice.
7. No file, graphic, database, text, or other material found at the Aquarius Media Services website can be used as evidence in any proceeding or forum whatsoever.
8. All Traffic detected as spam will be non paying.
9. Aim Clicks code shall not appear on sites that have used unethical practics such as Trojan Horses, worms, viruses, Active X, and "spyware" to obtain traffic.
10. Sites with extremely poor revenue numbers because of but not limited to, placement that wi.
11. Any site we feel in our sole discretion that is comitting fraud against us shall be immeditely removed without pay. Furthermore we will retain any evidence to be used in a legal forum against the fraudulant party.

5. Fraud and Fraud Screening

1. Fraud is defined as the majority of the click traffic sent via your account violating our rules 4(e), 4(f), 4(i) our most serious rules.
2. Any site found committing fraud will not be paid.
3. You agree to abide by the data collection done at our server(s) and these will supercede any collection you may do.
4. Fraud can also be decided by comparing the suspected Fraud sites data to our Network averages.
